Welcome to The Qi Affiliate Program (“Program”). These Affiliate Program Terms & Conditions (“Terms”) govern participation in the Program offered by The Qi (“The Qi,” “we,” “us,” or “our”).

By applying to or participating in the Program, you (“Affiliate”) acknowledge that you have read, understood, and agree to these Terms.

1. Program Participation

The Qi Affiliate Program allows approved affiliates to earn commissions by referring customers to The Qi through approved affiliate links, discount codes, or other tracking methods provided through our affiliate platform, Refersion.

Acceptance into the Program is at The Qi’s sole discretion. We reserve the right to approve or reject any application and to remove an Affiliate from the Program at any time in accordance with these Terms.

Affiliates must be at least 18 years old.

2. Commission & Tracking

Affiliates earn commissions on qualifying purchases attributed to their approved affiliate link or code according to the commission rate and attribution rules associated with their offer in Refersion.

Commission rates, attribution windows, eligible products, promotional incentives, and other offer details may vary and will be communicated through Refersion or directly by The Qi.

Commissions are calculated on qualifying net sales and may exclude taxes, shipping charges, discounts, refunds, returns, cancellations, fraudulent transactions, chargebacks, and other amounts determined by The Qi to be ineligible.

The Qi reserves the right to review, adjust, withhold, or reverse commissions associated with returned or cancelled orders, fraudulent activity, tracking errors, violations of these Terms, or other non-qualifying transactions.

3. Payments

Approved commissions will be paid according to the payment method and schedule communicated through Refersion.

Affiliates are responsible for providing accurate payment and tax information and for any taxes resulting from commissions received through the Program.

4. Affiliate Disclosures & FTC Compliance

Affiliates must clearly and conspicuously disclose their material relationship with The Qi whenever promoting The Qi or its products.

Disclosures must comply with the Federal Trade Commission’s Endorsement Guides and all other applicable advertising laws and regulations.

For example, when applicable, Affiliates should clearly communicate that they may earn a commission when someone purchases through their link or otherwise clearly disclose their relationship with The Qi.

Disclosures must be easy for consumers to notice and understand and should appear near the endorsement, recommendation, affiliate link, or promotional content.

5. Honest Endorsements

We want our Affiliate community to share The Qi authentically.

Affiliates may only make statements reflecting their honest opinions, experiences, and beliefs. Affiliates may not make false, misleading, deceptive, or unsubstantiated statements about The Qi or its products.

Affiliates are never required to provide a positive review.

6. Health & Product Claims

Because The Qi offers wellness, tea, herbal, and functional products, Affiliates must take particular care when discussing product benefits.

Affiliates may only make health, wellness, ingredient, or product claims that have been expressly provided or approved by The Qi for promotional use.

Unless expressly authorized by The Qi, Affiliates may not claim or imply that a The Qi product diagnoses, treats, cures, prevents, or mitigates any disease or medical condition.

Affiliates may not make unauthorized claims regarding hormones, menopause, anxiety, depression, insomnia, weight loss, fertility, digestive disorders, disease treatment, or other medical or therapeutic outcomes.

Personal experiences must not be presented as guaranteed or typical results.

When in doubt about a product claim, Affiliates should contact The Qi before publishing it.

7. Promotional Guidelines

Affiliates are encouraged to promote The Qi through authentic content on approved websites, blogs, newsletters, social media accounts, podcasts, video platforms, and other legitimate channels.

Unless The Qi provides prior written approval, Affiliates may not:

Run paid search advertisements bidding on “The Qi,” “The Qi Tea,” “Drink The Qi,” or confusingly similar trademarks or branded search terms.

Create websites, domains, social media accounts, usernames, or advertisements that impersonate The Qi or could reasonably be mistaken for an official The Qi property.

Represent themselves as employees, agents, representatives, or official spokespersons of The Qi.

Use misleading redirects, cookie stuffing, forced clicks, adware, spyware, or other deceptive tracking practices.

Promote unauthorized coupon codes or publish The Qi offers on coupon, deal, cashback, or discount websites without approval.

Send unsolicited commercial email, SMS, direct messages, or other communications in violation of applicable laws.

Purchase products through their own affiliate links or otherwise manipulate transactions for the primary purpose of earning commissions.

Make false, misleading, offensive, discriminatory, defamatory, or unlawful statements in connection with The Qi.

8. Discounts & Promotional Codes

Affiliates may only promote discount codes and offers that have been provided or approved by The Qi.

Expired, unauthorized, altered, or otherwise invalid promotions may not be advertised as current The Qi offers.

9. The Qi Intellectual Property

The Qi may provide approved logos, photographs, product images, copy, videos, links, and other brand assets (“Brand Materials”) for Affiliate use.

The Qi grants approved Affiliates a limited, non-exclusive, revocable, non-transferable license to use these Brand Materials solely for promoting The Qi while participating in the Program.

All trademarks, trade names, logos, product names, photographs, designs, copy, and other intellectual property belonging to The Qi remain the property of The Qi or their respective owners.

Participation in the Program does not grant Affiliate ownership of any The Qi intellectual property.

10. Affiliate Content

Affiliates retain ownership of original content they independently create.

If an Affiliate gives The Qi express permission to repost or otherwise use specific Affiliate-created content, the permitted use will be governed by that permission or any separate agreement between the Affiliate and The Qi.

Participation in the Affiliate Program alone does not transfer ownership of an Affiliate’s original content to The Qi.

11. Confidentiality

Affiliates may occasionally receive confidential or non-public information regarding The Qi, including upcoming products, launches, promotions, business information, or marketing plans.

Unless The Qi authorizes disclosure, Affiliates agree not to disclose confidential information to third parties or publicly share it before its authorized release.

12. Independent Contractor Relationship

Affiliates participate in the Program as independent contractors.

Nothing in these Terms creates an employment, agency, partnership, franchise, joint venture, or other similar relationship between Affiliate and The Qi.

Affiliates do not have authority to make commitments or representations on behalf of The Qi.

13. Termination

Either The Qi or Affiliate may end participation in the Program at any time.

The Qi may immediately suspend or terminate an Affiliate for violating these Terms, engaging in fraudulent or deceptive activity, making unauthorized product or health claims, damaging the reputation of The Qi, or engaging in conduct The Qi reasonably determines is inconsistent with the Program.

Upon termination, Affiliate must stop using The Qi affiliate links, promotional codes, and Brand Materials as requested.

Commissions resulting from fraud, abuse, prohibited activity, or violations of these Terms may be cancelled or withheld to the extent permitted by applicable law.

14. Changes to the Program

The Qi may modify the Program, including commission structures, promotional rules, eligible products, these Terms, or other Program features.

Material changes will be communicated through Refersion, email, or another reasonable method when appropriate.

Continued participation following the effective date of updated Terms constitutes acceptance of those Terms.

15. Limitation of Liability

To the fullest extent permitted by applicable law, The Qi will not be liable for indirect, incidental, special, consequential, or punitive damages arising from participation in the Program.

The Qi does not guarantee any particular amount of traffic, sales, commissions, revenue, or other results from participation in the Program.

16. Compliance With Laws

Affiliates are responsible for complying with all applicable federal, state, local, and international laws and regulations relating to their participation in the Program, including advertising, endorsement, privacy, intellectual property, email marketing, and consumer protection requirements.

By joining and participating in The Qi Affiliate Program, you acknowledge that you have read, understood, and agree to these Terms.

The Qi (“The Qi,” “we,” “us,” or “our”) respects the privacy of the creators, publishers, influencers, and other partners who apply to or participate in The Qi Affiliate Program (“Program”).

This Affiliate Program Privacy Policy explains how personal information associated with the Program may be collected, used, disclosed, and protected.

The Program is administered with the assistance of Refersion, a third-party affiliate marketing platform. Refersion separately processes information in accordance with its own privacy policy and terms.

1. Information We Collect

When you apply to or participate in The Qi Affiliate Program, we or our service providers may collect information such as:

Name

Email address

Mailing address

Telephone number

Business or company information

Website, blog, and social media profiles

Information provided in your Affiliate application

Affiliate account information

Payment and tax-related information where required

Affiliate links and promotional codes

Referral activity

Clicks, conversions, qualifying purchases, commissions, and other performance information

Communications between you and The Qi regarding the Program

Technical information associated with your interaction with the Affiliate platform

Some information may be collected directly by Refersion or payment providers rather than by The Qi.

2. How We Use Affiliate Information

We may use personal information associated with the Program to:

Review and process Affiliate applications

Establish and administer Affiliate accounts

Track referrals, purchases, and commissions

Calculate and facilitate commission payments

Communicate about Affiliate opportunities, promotions, product launches, campaigns, and Program updates

Provide Affiliate support

Evaluate Affiliate and Program performance

Detect and prevent fraud or misuse

Enforce our Affiliate Program Terms & Conditions

Maintain business and financial records

Comply with tax, accounting, legal, and regulatory obligations

Improve and administer The Qi Affiliate Program

3. Refersion and Other Service Providers

The Qi uses Refersion to help operate its Affiliate Program.

Information necessary to administer the Program may therefore be processed by Refersion and other service providers involved in functions such as affiliate tracking, analytics, communications, payment processing, fraud prevention, technology infrastructure, and professional services.

These third parties may process information according to their respective agreements and privacy policies.

4. Payment Information

Payment, banking, tax, or other financial information required to pay Affiliate commissions may be collected or processed by Refersion, its payment partners, or other payment providers.

The Qi may receive information necessary to administer payments, maintain records, and comply with applicable tax and legal requirements.

5. How We Share Information

We may share Affiliate information with service providers and professional advisors when reasonably necessary to operate the Program or our business.

We may also disclose information when required by law, regulation, legal process, or governmental request; to enforce our agreements; to investigate suspected fraud or unlawful activity; or to protect the rights, property, and safety of The Qi, our customers, Affiliates, or others.

We may disclose or transfer information in connection with an actual or proposed merger, acquisition, financing, restructuring, sale of assets, or other corporate transaction, subject to applicable law.

We do not sell Affiliate personal information for money.

6. Data Retention

We retain Affiliate information for as long as reasonably necessary to administer the Program and fulfill the purposes described in this Privacy Policy.

Certain information may be retained after an Affiliate leaves the Program when necessary for legitimate business purposes, including maintaining transaction histories, resolving disputes, preventing fraud, fulfilling tax and accounting obligations, enforcing agreements, and complying with applicable laws.

7. Data Security

We take reasonable administrative, technical, and organizational measures designed to protect personal information under our control.

However, no internet transmission, electronic storage system, or information security measure can be guaranteed to be completely secure.

8. Your Privacy Rights

Depending on where you live, applicable privacy laws may provide rights regarding your personal information, which may include the right to request:

Access to certain personal information we maintain about you

Correction of inaccurate personal information

Deletion of certain personal information

Information regarding how your personal information is used or disclosed

Other rights provided under applicable privacy laws

Certain information may need to be retained when permitted or required by law, including transaction, payment, tax, fraud-prevention, or legal records.

We may need to verify your identity before fulfilling certain privacy requests.

9. Communications

We may communicate with Affiliates regarding Program administration, account activity, commissions, products, campaigns, opportunities, and Program updates.

Where required by applicable law, Affiliates may opt out of promotional communications. Administrative or transactional communications necessary to operate the Affiliate Program may still be sent.

10. International Participants

Affiliate information may be processed in countries other than the country in which an Affiliate resides, including the United States.

Where required, we take appropriate measures regarding international transfers of personal information in accordance with applicable law.

11. Children's Privacy

The Qi Affiliate Program is intended for individuals who are at least 18 years old. We do not knowingly accept individuals under 18 into the Program.

12. Changes to This Privacy Policy

We may update this Affiliate Program Privacy Policy periodically to reflect changes to the Program, our practices, technology, legal requirements, or other factors.

When appropriate, we will update the effective date and provide notice of material changes.
